Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Wyld Cardz mobile application ("App," "Service," or "we," "us," "our"). These Terms form a legally binding agreement between you and Wyld Cardz ("Company").
By downloading, installing, or using Wyld Cardz, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the App.
Eligibility
You must be at least 13 years of age to use Wyld Cardz. By using the App, you represent and warrant that you meet this requirement. If you are between 13 and 18 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
To purchase a paid subscription, you must be at least 18 years of age (or the age of majority in your jurisdiction) and have the legal authority to enter into a binding contract.
We do not knowingly permit access by children under 13. If we become aware that a user is under 13, we will terminate access and delete any associated data.
Description of Service
Wyld Cardz is an AI-powered flashcard generation application that allows users to photograph educational materials (such as textbook pages, notes, or study guides) and automatically generate structured flashcard sets for study purposes.
The Service includes:
AI-powered flashcard generation from uploaded images
Storage and organization of generated flashcard bundles
Study and practice modes including Daily Review and other challenges
Optional paid subscription plans that unlock additional features and higher usage limits
We reserve the right to modify, suspend, or discontinue any feature of the Service at any time with or without notice.
Account and Device Identity
Wyld Cardz does not require you to create a traditional account. Instead, the App generates an anonymous random identifier ("Device ID") on first launch, stored locally on your device and in our database. This Device ID is used to associate your bundles, subscription status, and progress with your device.
You are responsible for maintaining access to your device. If you reset the app, uninstall it, or reset your Device ID, your local session will be lost. Subscriptions are linked to your Device ID and email address — if you lose your Device ID, contact us at support@wyldcardz.app to assist with subscription recovery.
We are not responsible for loss of data resulting from device loss, factory reset, or voluntary app uninstallation.
Acceptable Use
You agree to use Wyld Cardz only for lawful, personal, and educational purposes. You may not use the Service to:
Upload, transmit, or process any content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable
Infringe upon or violate the intellectual property rights of any third party (see Section 5 below)
Circumvent, disable, or interfere with security-related features of the Service
Attempt to reverse-engineer, decompile, or extract the source code of the App
Use automated scripts, bots, or other tools to interact with the Service in a way not intended by its design
Resell, sublicense, or commercially exploit the Service or any content generated by it
Attempt to gain unauthorized access to our systems, servers, or databases
Use the Service in any manner that could impair, overburden, or damage our infrastructure
We reserve the right to suspend or terminate your access without notice if we determine, in our sole discretion, that you have violated these Terms.
User Content and Copyright
5a. Your Content
When you upload images to Wyld Cardz ("User Content"), you retain any intellectual property rights you hold in that content. By uploading images, you grant us a limited, non-exclusive, worldwide, royalty-free license to process and transmit those images solely for the purpose of generating your flashcards. We do not store your uploaded images beyond the duration needed for processing (see our Privacy Policy).
5b. Copyright Responsibility
Wyld Cardz is designed for personal educational use. You are solely responsible for ensuring that any content you upload does not infringe upon the copyright, trademark, or other intellectual property rights of third parties.
This includes textbooks, course materials, articles, and other published works. Many textbooks and educational materials are protected by copyright. The following uses are generally considered acceptable under applicable fair use or fair dealing principles in many jurisdictions:
Personal study use of materials you have lawfully purchased or licensed
Limited excerpts for the purpose of commentary, criticism, or education
However, we make no representations or warranties regarding whether your specific use constitutes fair use or fair dealing in your jurisdiction. If you are unsure, consult a qualified legal professional.
You agree to indemnify, defend, and hold harmless the Company from and against any claims arising from your uploading of copyrighted material without authorization.
5c. AI-Generated Content
Flashcards generated by the AI are derived from your uploaded content. You may use these generated flashcards for personal educational purposes. You may not sell, redistribute, or publish AI-generated flashcard sets commercially without explicit written permission from us.
AI-Generated Content Disclaimer
Wyld Cardz uses artificial intelligence (powered by Anthropic's Claude API) to generate flashcard content from your uploaded images. While we strive for quality and accuracy, AI-generated content may contain errors, omissions, or inaccuracies.
We do not guarantee the factual accuracy, completeness, or fitness for any particular purpose of any AI-generated flashcard
Generated content should not be relied upon as a substitute for authoritative sources, professional advice, or official educational materials
You are responsible for verifying the accuracy of any generated content before relying on it for academic, professional, or other important purposes
Subscriptions and Payments
7a. Plans and Pricing
We offer the following subscription plans:

Prices are in USD and subject to change. We will notify active subscribers of price changes at least 30 days in advance via email.
7b. Payment Processing
All payments are processed by Stripe, Inc. ("Stripe"), our third-party payment processor. When you subscribe, you will be redirected to a Stripe-hosted checkout page. By completing a purchase, you:
Agree to provide accurate and complete billing information
Authorize Stripe to charge your payment method on a recurring basis
Acknowledge that your payment information is processed and stored by Stripe in accordance with Stripe's Privacy Policy available at https://stripe.com/privacy
We do not receive or store your full payment card details. Stripe provides us with a token and limited billing information (last 4 digits, card brand, expiry) for subscription management purposes.
7c. Auto-Renewal
Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. By subscribing, you authorize us (through Stripe) to charge your payment method on a recurring basis.
7d. Free Trial
If a free trial is offered, it will be clearly disclosed at the time of signup. At the end of the free trial, your subscription will automatically convert to a paid plan at the stated rate unless you cancel beforehand.
7e. Cancellation
You may cancel your subscription at any time through the Manage Billing section of the App. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until that date.
7f. Refunds
We do not offer refunds for subscription fees already charged, except where required by applicable law (including EU/UK consumer protection regulations). If you believe you were charged in error, contact us at support@wyldcardz.app within 14 days of the charge.
Users in the European Union have the right to withdraw from a purchase within 14 days under the EU Consumer Rights Directive. However, by accessing digital services immediately after purchase, you acknowledge that your right of withdrawal may be waived to the extent permitted by applicable law.
7g. Plan Changes
You may upgrade from Plus to Ultra at any time. An upgrade creates a new subscription; your prior plan will be cancelled and the new plan will take effect immediately. Downgrades take effect at the start of the next billing period.
Free Tier
Each device is entitled to one (1) free bundle generation without a subscription. Additional bundle generations require an active paid subscription. The free bundle does not expire but cannot be "refunded" or transferred.
Intellectual Property
All rights, title, and interest in and to the Wyld Cardz application, including its design, code, branding, logo, user interface, and underlying technology, are owned by or licensed to the Company and are protected by intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you.
You may not copy, reproduce, distribute, or create derivative works of the App or its components without our express written permission.
Third-Party Services
The Service integrates with third-party services including Anthropic (AI processing), Stripe (payments), and Supabase (data storage). Your use of those services is also subject to their respective terms and privacy policies. We are not responsible for the practices or content of any third-party services.
Service Availability
We do not guarantee that the Service will be available at all times, uninterrupted, or error-free. We may experience downtime due to maintenance, infrastructure issues, or events outside our control. We are not liable for any loss or inconvenience resulting from service unavailability.
Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if you violate these Terms. Upon termination, your right to use the Service ceases immediately. Sections relating to intellectual property, disclaimers, limitation of liability, and governing law survive termination.

Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI-GENERATED CONTENT.
WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, THAT IT WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:
ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES
DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA
DAMAGES ARISING FROM ANY AI-GENERATED CONTENT THAT IS INACCURATE OR MISLEADING
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $50 USD.
SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OF CERTAIN WARRANTIES OR LIMITATIONS OF LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
Indemnification
You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any third-party rights, including intellectual property rights.
Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of GA, US, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in GA, US, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
Class Action Waiver: To the extent permitted by law, you waive any right to participate in a class action lawsuit or class-wide arbitration against the Company.
Users in the European Union retain the right to bring claims before the courts of their country of residence and may use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
Changes to These Terms
We reserve the right to update these Terms at any time. If we make material changes, we will update the "Last updated" date at the top of this document and, where feasible, notify active subscribers by email. Your continued use of the App after any changes constitutes your acceptance of the updated Terms.
Miscellaneous
Entire Agreement: These Terms constitute the entire agreement between you and the Company regarding the Service and supersede all prior agreements.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force.
No Waiver: Our failure to enforce any provision does not constitute a waiver of our right to enforce it in the future.
Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
